This privacy notice informs you pursuant to Art. 13 GDPR about how we process your personal data when you send us a request through the CXR App contact form or support form. It can be read on its own; general information is provided in the “Privacy Policy”.

The controller within the meaning of Art. 4(7) GDPR is:

Visual Memory Works GmbH
Elbestraße 10, 45768 Marl, Germany
Managing Director: Ilker Secaat KARA
Local Court of Gelsenkirchen, HRB 18062

CXR App is offered and operated by Visual Memory Works GmbH (“VMW”). It is your contact for sales, billing, payment processing and support.

Requests sent through the contact form are intended for the hello@cxr.app mailbox, and requests sent through the support form for the support@cxr.app mailbox. These shared CXR addresses do not change the fact that VMW is the controller and the provider of the services.

Contact person for data protection inquiries: Prof. Ergün Kalaycı, e-mail: erguen.kalayci@visualmemoryworks.de. This person receives data protection inquiries for Visual Memory Works GmbH. This role does not involve a formal appointment as a data protection officer within the meaning of Art. 37 GDPR.

FORMS CONCERNED AND DATA PROCESSED

We process the information you enter into the respective form:

  • Contact form: first and last name (required field), e-mail address (required field), phone number (optional), subject (required field), message (required field)
  • Support form: additionally, the selection of the app concerned (required field; Linke, Catalog, Menux, Eventix, Momento or Selecto)

In addition, we process technical information about the submission, namely the address of the page from which you submit the form, the language of the page, the type of form (contact or support), the responsible provider (VMW) and the time of submission, as well as the information on which version of this privacy notice was displayed to you when you submitted the form and at what time.

PURPOSE OF PROCESSING

We process this data to handle and respond to your contact or support request. The technical information serves to enable us to assign and handle your request.

LEGAL BASIS

  • Art. 6(1)(b) GDPR, if your request relates to the performance of a contract or to pre-contractual measures, for example support for an existing account or subscription, or a request for a quote.
  • Art. 6(1)(f) GDPR in all other cases; our legitimate interest is to properly respond to requests addressed to us.

Consent is not required for handling your request. We do not use your information for marketing or newsletters; a newsletter subscription is not offered through these forms.

RECIPIENTS

Your information is received by the VMW departments responsible for handling it. We pass data on to service providers only to the extent necessary for e-mail, ticket or hosting operations; e-mail and hosting service providers act on behalf of and on the instructions of VMW (Art. 28 GDPR). Data is disclosed to other third parties only if we are legally obliged to do so.

TRANSFER TO THIRD COUNTRIES

If the service providers used process data outside the European Union and the European Economic Area, this takes place only if the requirements of Art. 44 et seq. GDPR are met, that is, in particular where there is an adequacy decision of the European Commission or with appropriate safeguards such as standard contractual clauses. Upon request, we will inform you which safeguards exist for a specific transfer.

RETENTION PERIOD

We store your request and the associated information for as long as necessary for handling, responding to and documenting it. Afterwards, the data is deleted or anonymized, unless statutory retention or limitation periods or the establishment, exercise or defense of legal claims require further storage; in that case, processing is restricted to that purpose.

Our support target – first response within 24 hours, information on the solution or the resolution process within 48 hours – is a response target and not a retention period.

PROVISION OF DATA

Providing the data marked as required fields is necessary for handling your request. Without this information, we cannot handle your request. The remaining information is optional. There is no statutory or contractual obligation to provide it.

AUTOMATED DECISION-MAKING

No exclusively automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place.

YOUR RIGHTS

To the extent the statutory requirements are met, you have the following rights:

  • Access (Art. 15 GDPR)
  • Rectification (Art. 16 GDPR)
  • Erasure (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Objection to processing based on legitimate interests (Art. 21 GDPR)

To exercise your rights, please contact erguen.kalayci@visualmemoryworks.de (contact person for data protection inquiries: Prof. Ergün Kalaycı). Further information is provided in the document “Personal Data Requests — Access, Correction, Export and Deletion”.
