CXR App is a platform and service brand. CXR App is offered and operated by Visual Memory Works GmbH (“VMW”). VMW is your contact for sales, billing, payment processing and support.
TRADEMARKS, LICENSES AND INTELLECTUAL PROPERTY
The names, trademarks and logos of CXR App and the products are protected. They may be used only within the scope of the Terms of Use. Third-party rights remain unaffected.
Use of the platform does not give users any transfer of ownership or rights in the CXR App trademark, the software infrastructure, the interfaces, the documentation or the related intellectual property elements. Further details are set out in the document “Trademarks, Licenses and Intellectual Property”.
NATURE OF THE SERVICE AND SCOPE OF ACTIVITIES
The services offered under the CXR App brand comprise online software services such as digital software for business organization, SaaS products, linking and catalog systems, the creation and management of offers, and the management of content and processes. The subject of this text is digital software services. If NFC cards, smart QR stands or other physical products are offered separately, their terms of sale and delivery will be explained separately.
ROLE OF THE PLATFORM AND COMMERCIAL RELATIONSHIPS
The platform is a technical infrastructure with which users can manage their own content and business processes. Persons or businesses that use the platform are themselves responsible for:
- all content they present to their own customers, including prices, product and service descriptions, images, links, offers and similar materials,
- the contracts they conclude with their own customers, including collection of payments, delivery and performance of services, and business commitments,
- all consequences of the legal and business relationship between them and their own customers.
VMW is not a party to these relationships between users and their customers or third parties.
OFFERING AND CONTRACT PARTY
For new purchases through the English and German versions of CXR App, you conclude contracts for the services with VMW. VMW is your contact for sales, billing, payment processing and support. You will find the details about VMW in the Company and Registration Details.
USER CONTENT, DATA AND LEGALITY
Users are responsible for the accuracy and lawfulness of the data they enter into the system and for ensuring that third-party rights are not infringed. For content that businesses place in their apps, those businesses are controllers within the meaning of the GDPR; VMW processes it as a processor (Art. 28 GDPR). VMW is not obliged to check content uploaded by users in advance for accuracy or lawfulness.
