Role of the Platform and Commercial Relationships
The platform is a technical infrastructure with which users can manage their own content and business processes. Persons or businesses that use the platform are themselves responsible for:
- all content they present to their own customers, including prices, product and service descriptions, images, links, offers and similar materials,
- the contracts they conclude with their own customers, including collection of payments, delivery and performance of services, and business commitments,
- all consequences of the legal and business relationship between them and their own customers.
CXR App and VMW are not parties to these relationships between users and their customers or third parties.
SALES TO END CUSTOMERS
If users sell their own products or services to their end customers through the platform, for example photos via Momento or orders via Menux, the contract is concluded exclusively between the users and their end customers. In this respect, the users are the contracting party and, for the personal data of these individuals, controllers within the meaning of the GDPR. They are themselves responsible for price information, information obligations, rights of withdrawal, invoicing and the performance of their contracts. VMW provides the technical platform for this and processes the personal data of these individuals as a processor. Where a product supports the acceptance of payments, this requires that the relevant payment service provider accepts and verifies the business as a merchant; a particular payment method is not promised for all products or businesses.
CONTRACTUAL RELATIONSHIP WITH VMW
The contractual relationship between customers who purchase through the English and German versions and the service is with Visual Memory Works GmbH. For personal data that customers process in their apps, the GDPR / DSGVO Data Protection Notice applies.
